By using the Four51 Customer Forum (the "Forum Four51"), you acknowledge your agreement to abide by this Acceptable Use Policy as this Acceptable Use Policy is updated by Four51 from time to time. Use of the Forum is conditional on acceptance of this Acceptable Use Policy, and continued use of the Forum following any changes to this Acceptable Use Policy constitutes acceptance of those changes.

1.    YOUR RESPONSIBILITY FOR CONTENT.  Four51 may, but is not required to monitor content or information posted, transmitted or accessible through the Forum, and You are responsible for any content posted, transmitted or accessed through the Forum. Four51 may use filters and other technology in the effort to detect and remove and limit spam and other undesirable communication, and to protect the Forum from disruption or damage, as Four51 considers necessary or appropriate in its sole discretion. Action taken by Four51 to limit transmission or access to any communication or content is not an assumption by Four51 of responsibility for Your conduct.

2.    YOUR RESPONSIBILITY FOR CONDUCT.  Your use of the Forum must be conducted in accordance with all applicable laws and in a manner that does not interfere with use of the Forum by others. Examples of unacceptable conduct include use of the Forum to defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others. Posts must pertain to the legitimate business use of Four51 technology and services, and related technology and services. Content that is personal in nature, including commercial solicitation, is prohibited, and Four51 at its sole discretion will remove offending posts and take additional action if necessary.

3.    FOUR51’S RIGHT TO YOUR CONTENT.  In providing the Forum, Four51 must make and retain copies of the content and information you make available through the Forum. You grant to Four51 a license to use, reproduce, display, perform, and distribute such content and information, but only as necessary for Four51 to manage, operate and provide the Forum, for purposes of security, and for the investigation of complaints and possible unlawful activities.

4.    ENFORCEMENT.  Four51 may interrupt, suspend, limit or restrict any part of the Forum to the extent Four51 considers necessary or appropriate to respond to any suspected violation of this Acceptable Use Policy. This includes the right to remove content that, in Four51’s sole discretion, is in violation of this Acceptable Use Policy. You consent to the release by Four51 to law enforcement authorities of any account information about Your Forum use that Four51 deems necessary or appropriate to respond to inquiries regarding the Forum or You use of the Forum.

5.    COMMUNICATIONS WITH FOUR51.  You acknowledge that communication through the Forum is not a substitute for any means of notice or communication that is required in any agreement with Four51 or any third party, nor is Forum content meant to replace Four51’s Technical Support services in whole or part. Nothing contained in the Forum, accessible through the Forum or communicated through the Forum will modify, amend or alter the terms and conditions of any such agreement.

5.    INDEMNIFICATION.  You will indemnify, defend and hold Four51 and its current or former affiliates, employees, officers, directors, agents, Forum providers and suppliers, harmless from any liability, loss, claim or expense, including attorney’s fees and expenses, arising out of, or relating to, Your use of the Forum. This provision will survive any termination or cancellation of Your use of the Forum.

6.    SECURITY.  A unique username and password will be assigned to You for access to the Forum. You may not disclose any such username or password to any other party, or otherwise give any other party access to the Forum, or any information obtained through the Forum. You assume responsibility for any unauthorized use of any username or password assigned to You, and You must promptly inform Four51 of any actual or suspected unauthorized use. You must not interfere, disrupt, or attempt to interfere or disrupt the operation of the Forum.

7.    DISCLAIMER OF WARRANTIES.  Four51 disclaims all warranties with respect to the Forum.

8.    LIMITATION OF LIABILITY.  You assume full responsibility for the Your use of the Forum and the Your account, including all Forums, products and information obtained from third parties through use of the Forum. Four51 is not liable for any direct or indirect damages that result from You use or inability to use the Forum. Four51’s liability of all kinds with respect to each You (except liability for gross negligence or intentional misconduct) is limited to the fees remitted by that You for the Forum.

9.    TERMINATION.  You may terminate Your use of the Forum at any time. Four51 may terminate Your access to all or part of the Forum, for any reason and without notice. Four51 will provide notice of termination as soon as reasonably possible after the termination occurs.

10.    MISCELLANEOUS.  This Acceptable Use Policy is governed by Minnesota law and is the entire agreement between You and Four51 with respect to the Forum and Your use of the Forum. If any portion of this Acceptable Use Policy is held invalid or unenforceable, the remaining provisions will remain in full force and effect. No failure by Four51 to enforce any right or obligation under this Acceptable Use Policy will be a waiver of that right.
